For the purposes of this annexure H, Facility Operation Fee, Facility Operations Agreement, Facility Items and Specified Affiliate have the meaning given to those terms in the Implementation Agreement.
Buyer and CIGNA shall provide reasonable use of IBM/CIGNA Facility Items substantially equivalent to those made available by Buyer or CIGNA to its own personnel who perform similar functions.

Supplier is responsible for any damage to IBM/CIGNA Facility Items resulting from the abuse, misuse, neglect or gross negligence of Supplier (or its subcontractors or other guests) or other failure to comply with its obligations respecting such resources.
Supplier shall keep and use the IBM/CIGNA Facility Items in a reasonable and efficient manner.

This Amendment No. 2 (“Amendment”) effective on November 2, 2015 to the Commercial Paper and Other Facility Items, State Term Contract No. 640-002-12-1 (“Contract”), between the State of Florida, Department of Management Services (“Department”), and Dade Paper & Bag Company (“Contractor”) are collectively referred to herein as the “Parties.” All capitalized terms used herein shall have the meaning assigned to them in the Contract, unless otherwise defined herein.
Supplier may only use the IBM/CIGNA Facility Items for the sole and exclusive purpose of providing the Supplier Services.
Supplier shall not commit waste or damage to the IBM/CIGNA Facility Items or use them for any unlawful purpose or act.
