Facilities Modification definition

Facilities Modification has the meaning given such term in Section 5.2(b)(ii).
Facilities Modification means a capital improvement to meet operational changes or upgrades in response to requirements of regulatory agencies, but that does not result in a Capacity Expansion.

Examples of Facilities Modification in a sentence

  • The “Plant Facilities” means those certain pipelines, associated facilities and interconnects with Downstream Facilities that are, in each case, owned and operated by Provider but not located on the Plant Site, including the Hess North Dakota Pipeline, in each case, as the same may be modified and/or extended from time to time, including pursuant to a Facilities Modification, and as the same are more particularly described on Exhibit A-2.

  • Compressor Stations and Above-ground Facilities: Modification, replacement or addition involving new construction within existing Compressor Station property and/or above-ground facilities, including valves and monitoring, measuring, communications, cleaning or regulating devices.

  • The "LM4 Facilities" means those certain pipelines, associated facilities and interconnects with Downstream Facilities related to LM4 that are, in each case, to be owned (in whole or in part) and/or operated by the Provider Group but are not located on the LM4 Site, in each case, as the same may be modified and/or extended from time to time, including pursuant to a Facilities Modification, and as the same are more particularly described on Exhibit A-4.

  • If TFG cancels because of a PROJECT OWNER'S default, EARTHSHELL (on behalf of itself or SWEETHEART) shall be obliged to pay TFG only for Work relating to the Equipment Installation or Facilities Modification, as the case may be, actually performed on the Project through the fifteenth day after the notice is delivered less all such payments already made to TFG.

  • Capacity Expansion or Facilities Modification of the Intake Facilities, to the extent possible, shall be planned for through a Master Plan to be updated not less than every five years.

  • If the PROJECT OWNERS so terminate, TFG shall be entitled to compensation only for Work relating to the Equipment Installation or Facilities Modification, as the case may be, actually performed on the Project through the fifteenth day after the notice is delivered less all such payments already made to TFG.

  • Seaboard shall comply with other applicable requirements, including, but not limited to, submission of a Facilities Modification Form (Exhibit "D") or similar document as required by the Port for all improvements to real property at the Port.

Related to Facilities Modification

  • Permit modification means a revision to a Title V operating permit that cannot be accomplished under the provisions for administrative permit amendments found at rule 567—22.111(455B). A permit modification for purposes of the acid rain portion of the permit shall be governed by the regulations pertaining to acid rain found at rules 567—22.120(455B) to 567—22.147(455B). This definition of “permit modification” shall be used solely for purposes of this chapter governing Title V operating permits.

  • Contract Modification means any changes in the terms or provisions of the Contract which are reduced to writing and fully executed by both parties.

  • Cross-Series Modification means a modification involving (i) the Bonds or any agreement governing the issuance or administration of the Bonds, and (ii) the debt securities of one or more other series or any agreement governing the issuance or administration of such other debt securities.

  • Minor modification means a modification that does not significantly alter the nongovernmental function or purpose of the software or is of the type customarily provided in the commercial marketplace.

  • Major modification means any physical change in or change in the method of operation of a major stationary source that would result in a significant emissions increase of a regulated NSR pollutant and a significant net emissions increase of that pollutant from the major stationary source.
