Extended Disability definition

Extended Disability shall (i) mean you are unable, as a result of a medically determinable physical or mental impairment, to perform the duties and services of your position, or (ii) have the meaning specified in any disability insurance policy maintained by Covance, whichever is more favorable to you. Except as may be otherwise provided herein or in any applicable Covance compensation and benefit plans, Covance shall not be liable for any salary or benefit payments to you beyond the date of your voluntary termination of employment with Covance. Upon the termination of your employment with Covance for Cause or for Extended Disability, you shall not be entitled to any compensation or other benefits not already earned and owing to you on account of your services on the date of such termination of employment. The provision of any benefits pursuant to this Agreement shall be in lieu of, and not in addition to, any payment or benefits you otherwise would have been entitled to pursuant to any severance pay plan of the Company, including, without limitation, the Company’s Amended and Restated Severance Pay Plan.

The provision of any benefits pursuant to this Agreement shall be in lieu of, and not in addition to, any payment or benefits you otherwise would have been entitled to pursuant to any severance pay plan of the Company, including, without limitation, the Company’s Amended and Restated Severance Pay Plan.

In the event of a termination of employment for Cause or Extended Disability, you shall not be entitled to any compensation or other benefits not already earned and owing to you on account of your services on the date of such termination of employment except as provided above with respect to a termination for Extended Disability. Medical, dental, and life insurance will be continued, to the extent they are not otherwise prohibited under the respective plans, while you are receiving the Termination Payments.

Examples of Extended Disability in a sentence

  • No benefits will be paid under the Extended Disability Benefit if your Total Disability occurred before your effective date of insurance with us.

  • There is no ineligibility for Extended Disability Benefits because of work which is determined to be primarily for training under a recognized program of vocational rehabilitation.

  • No Extended Disability Benefits shall be payable for any period of disability covered by such waiver.

  • Reimbursement will be made for University contribution amounts upon approval for Extended Disability Leave.

  • Extended Disability Benefits are paid to the eligible employee monthly following exhaustion of sick leave payments subject to receipt of due proof.

  • An employee may waive irrevocably any right he/she may have to receive Extended Disability Benefits with respect to any period of disability by completing a waiver form furnished by the Insurer for that purpose.

  • An employee who exhausts Sick Leave Payments at full salary under Article 20 and who, at the time he/she exhausts such payments and during a continuous period of disability thereafter, is totally disabled as defined in (c)(1) below receives monthly Extended Disability Benefits for the period described in (c) below.

  • No benefits will be paid under the Extended Disability Benefit if the Insured’s Total Disability occurred before the Insured’s effective date of insurance with us.

  • Reinstated Extended Disability Benefits are paid to an eligible laid off employee weekly subject to receipt of due proof.

  • No Extended Disability Benefits shall be payable while an employee is on an authorized pregnancy leave of absence or could be placed on a pregnancy leave of absence by the Company in accordance with any pregnancy leave provision of the relevant provincial statutes.


More Definitions of Extended Disability

Extended Disability means a Disability which has not ended and which has existed for not less than nine (9) consecutive months as declared by a Supermajority Vote of the Board after the nine (9) month period and prior to the time a Disability ends.

Related to Extended Disability

  • Disability/Disabled means because of Injury or Sickness you are unable to perform the material duties of your Regular Occupation, or are receiving disability benefits under the Employer's plan, during the initial 9 months of Disability. Thereafter, you must be unable to perform all of the material duties of any occupation which you may reasonably become qualified based on education, training or experience, or are subject to the terms of a Rehabilitation Plan approved by the Insurance Company.

  • Recurrent Disability means a Disability caused by an Injury or Sickness that is the same as, or related to, the cause of a prior Disability for which Monthly Benefits were payable. A Recurrent Disability will be treated as follows.

  • Partial Disability or "Partially Disabled" means you, as a result of Injury or Sickness, are able to:

  • Disability or Disabled means that during the Elimination Period and your Own Occupation Period you are, as a result of Physical Disease, Injury, Mental Disorder, Substance Abuse or Pregnancy, unable to perform one or more of the Material Duties of your Own Occupation, and, due to such inability, your Work Earnings are less than 80% of your Indexed Predisability Earnings, and you are incapable of earning 80% or more of your Indexed Predisability Earnings. Your Work Earnings may be Deductible Income. See the “LTD Benefit Calculation” and “Deductible Income” sections.

  • Permanent Disability means the Employee’s inability to perform the essential functions of the Employee’s position, with or without reasonable accommodation, for a period of at least 120 consecutive days because of a physical or mental impairment.

  • Service-connected disability means a disability incurred or aggravated in the line of duty in the active military, naval, or air service as described in 38 USC 101(16).

  • Total Disability means a “permanent and total disability” within the meaning of Section 22(e)(3) of the Code and such other disabilities, infirmities, afflictions or conditions as the Committee by rule may include.

  • mental disability means one or more mental disorders, as defined in the most recent edition of the American Psychiatric Association's "Diagnostic and Statistical Manual of Mental Disorders", or a record of or regarding a person as having one or more such disorders;

  • Disabled or Disability means Disabled or Disability within the meaning of Section 409A of the Code and the regulations thereunder. Generally, this means that the Participant is unable to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or can be expected to last for a continuous period of not less than 12 months, or is, by reason of any medically determinable physical or mental impairment which can be expected to result in death or can be expected to last for a continuous period of not less than 12 months, receiving income replacement benefits for a period of not less than three months under an accident and health plan covering Employees of the Employer.

  • Catastrophic disability means a physical and not a psychological

  • Pregnancy disability means a pregnancy-related medical condition or miscarriage.

  • Disability Termination means termination by the Company of the Executive’s employment by reason of the Executive’s incapacitation due to disability. The Executive will be deemed to be incapacitated due to disability if at the end of any month the Executive is unable to perform substantially all of the Executive’s duties under this Agreement in the normal and regular manner due to illness, injury or mental or physical incapacity, and has been unable so to perform for either (i) three consecutive full calendar months then ending, or (ii) 90 or more of the normal working days during the 12 consecutive full calendar months then ending. Nothing in this paragraph alters the Company’s obligations under applicable law, which may, in certain circumstances, result in the suspension or alteration of the foregoing time periods.

  • Accidental disability means a physical or mental condition that

  • Disability means total and permanent disability as defined in Section 22(e)(3) of the Code.

  • Termination due to Disability means a termination of the Executive’s employment by the Company because the Executive has been incapable, after reasonable accommodation, of substantially fulfilling the positions, duties, responsibilities and obligations set forth in this Agreement because of physical, mental or emotional incapacity resulting from injury, sickness or disease for a period of (A) six (6) consecutive months or (B) an aggregate of nine (9) months (whether or not consecutive) in any twelve (12) month period. Any question as to the existence, extent or potentiality of the Executive’s disability shall be determined by a qualified physician selected by the Company with the consent of the Executive, which consent shall not be unreasonably withheld. The Executive or the Executive’s legal representatives or any adult member of the Executive’s immediate family shall have the right to present to such physician such information and arguments as to the Executive’s disability as he, she or they deem appropriate, including the opinion of the Executive’s personal physician.

  • Permanent total disability means incapacity because of accidental injury or occupational disease to earn any wages in any employment for which the employee may become physically suited and reasonably fitted by education, training or experience, including vocational rehabilitation; loss of both hands, or both feet, or both legs, or both eyes, or any two thereof, shall constitute permanent total disability;

  • Child with a disability means a child who, by reason of any of the following, needs special education and related services:

  • Long-Term Disability means the Grantee is receiving long-term disability benefits under the Employer’s long-term disability plan.

  • Qualified disability expenses means that term as defined in section 529A of the internal revenue code.

  • Temporary disability means wage loss replacement for the primary job;

  • Disability retirement for plan 1 members, means the period

  • Complete Disability as used herein shall mean the inability of Employee, due to illness, accident, or other physical or mental incapacity, to perform the services required under the Agreement for an aggregate of ninety (90) days within any period of 180 consecutive days during the term hereof; provided, however, that disability shall not constitute a basis for discharge for cause;

  • Multiple disabilities means concomitant impairments, the combination of which causes such severe educational problems that programs designed for the separate disabling conditions will not meet the student’s educational needs.

  • Physical disability means a severe, chronic condition that is attributable to a physical impairment that results in substantial limitations of physical functioning in three or more of the following areas of major life activities: self-care, receptive and expressive language, learning, mobility, self-direction, capacity for independent living, and economic self-sufficiency.

  • Disability Date means the date on which a Participant is deemed disabled under the employee benefit plans of the Corporation applicable to the Participant.
