Expert Determination Rules definition

Expert Determination Rules means the Rules for the Expert Determination of Commercial Disputes issued by the Institute of Arbitrators & Mediators, Australia as amended from time to time.
Expert Determination Rules means the rules published by the Expert Determination Body from time to time for the independent expert determination of disputes (which are, as at the date of this deed, the Resolution Institute Expert Determination Rules). GAAP means generally accepted accounting principles in Australia, including IFRS. Governmental Authority includes any governmental, semi-governmental, municipal or statutory authority, instrumentality, organisation, body or delegate (including any town planning or ME_212469013_16 development authority, public utility, environmental, building, health, safety or other body or authority) having jurisdiction, authority or power in Australia (whether federal, state or local) or any other part of the world. IFRS means international accounting standards within the meaning of the IAS Regulation 1606/2002 to the extent applicable to the relevant financial statements.

Examples of Expert Determination Rules in a sentence

  • In default of agreement, this will be finally determined by an independent expert in accordance with, and subject to, Resolution Institute Expert Determination Rules and unless the parties agree upon an expert, either party may request a nomination from the Chair of Resolution Institute.

  • If, and to the extent that, any such dispute or difference has not been settled pursuant to the mediation within 60 days of the commencement of the mediation, it shall, upon the filing of a Request for Expert Determination by either party, be referred to expert determination in accordance with the WIPO Expert Determination Rules.

  • In default of agreement on each Party's Contributions, this will be finally determined by an independent expert in accordance with, and subject to, Resolution Institute Expert Determination Rules and unless the Parties agree upon an expert, any Party may request a nomination from the Chair of Resolution Institute.

  • The Resolution Institute Expert Determination Rules as amended by this clause 19 apply to the expert determination, except where they conflict with this clause 19.
