Experimental Software definition

Experimental Software means any software delivered by BlackBerry that is not Commercially Released Software. Experimental Software is generally identified in the Software Center by BlackBerry as “Experimental,” “Alpha,” “Beta,” “Validated,” “Draft,” “Demo,” or “Trial” Software and includes all custom code and/or modifications to Commercially Released Software that might be created by Developer, including any Update which is not designated as “Generally Available”, “GA”, “Stable”, or “Official”.
Experimental Software means any software delivered by BlackBerry that is not Commercially Released Software. Experimental Software is generally identified in the Software Center by BlackBerry as “Experimental,” “Alpha,” “Beta,” “Validated,” “Draft,” “Demo,” or “Trial” Software and includes all custom code and/or modifications to Commercially Released Software that might be created by Customer, its Affiliates and their respective Developers, including Software delivered as part of Maintenance and Support or any professional support engagement (i.e. Custom Software) which is not designated as “Generally Available”, “GA”, “Stable”, or “Official”. For clarity, Experimental Software is not supported under the standard Maintenance and Support offering.
Experimental Software means a beta or test version of QPX or the InstaSearch Service that is made available to a limited number of customers, for a limited period of time, specifically for the purpose of testing new or modified features prior to the commercial release of those new or modified features as part of QPX or the InstaSearch Service. While Defendants remain free to determine whether a new or modified feature is ever ultimately incorporated into the commercially available version of QPX or the InstaSearch Service that must be licensed pursuant to this Final Judgment, Defendants may not use the exclusion of Experimental Software to circumvent the licensing obligation set forth in Section IV.E.

Examples of Experimental Software in a sentence

  • Neither Experimental Software, nor Custom Software is supported as part of BlackBerry standard Maintenance and Support offering.

  • For clarity, no warranties, representations or conditions of any kind are provided under this Agreement for Custom Software and Experimental Software.

  • All Custom Software and any Experimental Software which is not delivered under an “Early Access License” shall be deemed “Software” for purposes of the general restrictions outlined in section 4.6, warranty disclaimers, and liability limitations identified in this Agreement.

  • For so long as Customer Developers are consuming a supported Developer License and prior to the commercial release of such Software (if any), Customer may install and use the Experimental Software delivered under an Early Access License solely in support of other licenses granted to Customer herein and for no other purpose.

  • If Customer is seeking support for Custom Software or Experimental Software or if Customer wishes to accelerate fixes to the supported Commercially Released Software according to Customer directed priorities, then Customer may purchase add-on services under a separate agreement.

  • See section 5 of this Exhibit A for details regarding the licensed rights and restrictions applicable to evaluation licenses or early access licenses to Experimental Software.

  • Customers can obtain an evaluation license to Software, or early access licenses to Experimental Software.

  • All Custom Software and all Experimental Software shall be deemed “Software” for purposes of the general restrictions outlined in section 4.1, section 5 (Open Source Software and Third-Party Software), warranty disclaimers, and liability limitations identified in this Agreement.

  • Additionally, Experimental Software which is not delivered under an early access license and any Custom Software obtained from Blackberry is subject to licenses and restrictions identified in section 6 of this Exhibit A.

  • If Developer’s License Certificate indicates that Developer has obtained an “Early Access License”, then Developer has obtained a no charge Early Access License to Experimental Software (e.g. Software labeled as “Experimental”, “Alpha”, “Beta” in the Software Center) under the terms of this Agreement and this Section shall apply.
