  • In the event that the SPD fails to endorse the certificate within [7 (seven) days] of its issuance, then the certificate will be deemed to have been issued and endorsed, and the grant of access rights of the Internal Power Evacuation Infrastructure from the SPPD to SPD shall be deemed to have been completed.

  • Upon the expiry of 15 (fifteen) Days from such assessment the SPPD shall issue a certificate to the SPD as per the format prescribed under Annexure B certifying the completion, and grant of all necessary access rights to the SPD, of the Internal Power Evacuation Infrastructure (Completion Notice), which shall be endorsed by the SPD within 7 (seven) Days of its issue.

  • Provided that, the SPPD shall, at least 15 (fifteen) Days prior to the proposed completion of the Internal Power Evacuation Infrastructure, invite the SPD to undertake an assessment of the Internal Power Evacuation Infrastructure.

  • In the event the LC is not replenished within 7 (seven) days, TUSCO shall have right to regulate the SPD's access to the Internal Evacuation Infrastructure by issuing a one-month advance notice to the SPD in writing.

  • The operation and maintenance of the Internal Power Evacuation Infrastructure, from its completion as per Article 3.2(b) and for the Term of this Agreement, shall be carried out by the SPPD, or its authorized representative, at its own cost and risk.

  • If the SPD fails to achieve the COD of the Project (as per the terms of the PPA) within [6 (six) Months] after the expiry of the original SCSD of the Project due to the SPPD's failure, to construct and commission the Internal Power Evacuation Infrastructure or to ensure connectivity to the UPPTCL Substation, where such failure has not occurred as a consequence of a Force Majeure Event or for reasons attributable to the SPD, then the SPD shall be entitled to terminate this Agreement.

  • The cost of the Internal Power Evacuation Infrastructure up to the Delivery Point where the metering is done shall be borne by the SPPD.

The Receiving Party shall maintain all CEII in a secure place. The Receiving Party shall treat CEII received under this agreement in accordance with its own procedures for protecting CEII and shall not disclose CEII to anyone except its Authorized Representatives.
