If the County Executive or designee fail to respond in writing as provided in Step 3, or if the response is not satisfactory to ETTI, ETTI has the right to appeal the grievance to binding arbitration.
ETTI shall hold the County harmless from any and all claims and will indemnify it against any unusual costs in implementing these provisions, and shall indemnify the County for any claims made by the employee for deductions made in reliance on that certification, in accordance with Government Code §1157.12(a).
The County will promptly remit deductions to ETTI with a list of dues paying members.
At each step of the formal grievance procedure, a copy of the decision will be emailed to ETTI at the same time as the decision is sent to the grievant.

ETTI recognizes its responsibility as exclusive negotiating agent and agrees to represent all employees without discrimination, interference, restraint, or coercion.
Upon certification from ETTI that an employee has signed an authorization for the deduction of dues and approved insurance and benefit programs, the County will make payroll deductions in an amount to be determined by ETTI.
ETTI shares equally with the County the responsibility for applying this provision of the Agreement.
