  • Nothing in this Agreement is intended to or shall confer upon any employee or former employee of Enovis, the Enovis Group, ESAB or the ESAB Group any right to continued employment, or any recall or similar rights to any such individual on layoff or any type of approved leave.

  • Each copy must include all notices and legends embedded in ESAB Software and affixed to its medium and container as received from ESAB.

  • Customer must notify ESAB in writing of any nonconformity within the warranty period.

  • Following the Separation, ESAB shall not use the Enovis Specified Marks for any purpose; provided that, ESAB may continue to use the Colfax-Formative Marks in connection with the operation of the ESAB Business to the extent consistent with past practice so long as ESAB uses commercially reasonable efforts to phase out its use of the “Colfax” name as soon as reasonably practicable following the Separation.
