If, however, ERPA and the Disputing Parties do not resolve the dispute, then the issue of whether ERPA complied will be referred to an arbitrator pursuant to Section 22.
ERPA and the Disputing Parties will meet and confer to resolve whether non-compliance occurred, and what remedial actions, if any, should be taken.
