The costs of drafting and drawing the ERGO URANIUM SALE AGREEMENT and all costs incidental thereto, shall be borne and paid by ERGO MINING.

Notwithstanding anything to the contrary, ERGO MINING shall retrospectively with effect from the 23 November 2007, be responsible for the environmental management, environmental rehabilitation, health and safety and related costs in relation to the BRAKPAN PLANTS notwithstanding that the obligation in respect thereof shall have arisen prior to the 23 November 2007.
In no way derogating from the aforegoing, CROWN shall have the right to connect its plant and the CROWN RESOURCE (with the requisite pipelines and power cables) to what is generally known and described as the “ ” using, to the extent required, the line rights and SERVITUDES of ERGO MINING, and shall have access to such line rights and SERVITUDES.
The ERGO MINING ASSETS and the ERPM ASSETS shall, however, remain the exclusive property of ERGO MINING and ERPM respectively save and except in relation to any of such assets which may have been sold to and acquired by the ELSBURG JV pursuant to any of the ANCILLARY AGREEMENTS .

URANIUM SALE AGREEMENT shall be founded upon the veracity of the WARRANTIES which shall be deemed an integral part hereof by ERGO URANIUM in favour of ERGO MINING.
