  • The Customer must follow the instructions given by EQS Group in the relevant Documentation when describing, isolating, detecting and reporting errors or bugs.

  • The hardware, software and technical infrastructure used by the Customer can also influence EQS Group's Services.

  • EQS Group remains responsible for fulfilling the obligations assumed by EQS Group even if subcontractors are appointed.

  • If the legitimate interests of the Customer are adversely affected by a Continuous Modification to such an extent that the continued usage of the Services by the Customer cannot reasonably be expected, the Customer may terminate the affected Service in writing with a notice period of one month before the Continuous Modification takes effect and EQS Group shall refund any unearned pre-paid license fees.
