Nothing herein shall be construed as limiting faculty members from developing course materials using EPMI methods simply because the same or similar course has already been developed by another faculty member.

The measure of damages recoverable from EPMI by the Customer arising under or in connection with this Agreement, whether arising by negligence, intended conduct or otherwise, shall not include any amounts for indirect, special, consequential or punitive damages of any Party, including third parties, even if such damages are foreseeable.
