EPC Agreements means this Agreement, the Phase 1 EPC Agreement, the Phase 3 EPC Agreement and the Phase 4 EPC Agreement, and “EPC Agreement” means any one of them. For the avoidance of doubt, “other EPC Agreement” means an EPC Agreement other than this Agreement.

EPC Agreements has the meaning assigned to such term in the OpCo Senior Credit Agreement.

Examples of EPC Agreements in a sentence

• Such extension shall meet the requirements of this Attachment O and shall not relieve Contractor of any of its responsibilities to meet the requirements of Attachment O under the Phase 1 EPC Agreements.

• Borrower shall not materially revise any procedures in respect of the Performance Tests or accept the results of any Performance Test or any notice of Substantial Completion under the EPC Agreements without the prior consent of the Required Lenders in consultation with the Independent Engineer.

• The Parties expressly acknowledge and agree that a termination of this Agreement pursuant to this Section 6.4 shall have no effect on any then existing EPC Agreements or O&M Agreements.

• The Borrower shall (and shall cause each Borrower Party to), subject to the provisions of this Section 5.11, obtain the prior written consent of the Independent Engineer and the Administrative Agent prior to accepting or confirming that each applicable Project has achieved Substantial Completion, and/or Final Completion under the EPC Agreements (as such term is defined therein).

• Prior to the execution of this Agreement, Contractor or Contractor’s Affiliate performed engineering, cost estimating and related services and developed and provided, or verified, as applicable, (1) the information that forms the Scope of Work and Basis of Design in Attachment A, which was performed or verified pursuant to the FEED Agreement, and (2) the Phase 1 Work Product, which was created or obtained pursuant to the Phase 1 EPC Agreements.

EPC Agreements are the General Contractor Agreement concluded between M+W Z▇▇▇▇▇ ▇▇ GmbH and the Borrower on 13 December 2005 and 5 January 2006, the two contracts on the delivery of technical installations concluded between VON ARDENNE Anlagentechnik GmbH and the “Borrower”/“FS LLC” on 31 March 2006, the contract on the delivery of technical installations concluded between Cincinnati Machine LLC and the “Borrower” on 16 February 2006 and the contract on the delivery of technical installations concluded between NPC Corporation and the “Borrower” on 15 February 2006;

EPC Agreements means (i) that certain Engineering, Procurement and Construction Agreement dated as of April 8, 2008, as amended from time to time, with the Vogtle Owners, and (ii) that certain Engineering, Procurement and Construction Agreement dated as of May 23, 2008, as amended from time to time, with the VC Summer Owners.

EPC Agreements means, collectively, (i) that certain Engineering Procurement and Construction (EPC) Contract between LF1 and Vis ▇▇▇▇▇ dated August 31, 2011, (ii) that certain Engineering Procurement and Construction (EPC) Contract between LF2 and Vis ▇▇▇▇▇ dated August 31, 2011, (iii) that certain Engineering Procurement and Construction (EPC) Contract between LF3 and Vis ▇▇▇▇▇ dated August 31, 2011 and (iv) that certain Engineering Procurement and Construction (EPC) Contract between LF4 and Vis ▇▇▇▇▇ dated August 31, 2011.

EPC Agreements and “EPC Agreement” shall have the respective meanings given on Schedule 1.1B of this Agreement.

EPC Agreements means the ARB EPC Agreement, the Gas Pipeline EPC Agreement, the Haldor Engineering Agreement and the H&H EPC Agreement.

EPC Agreements means the engineering, procurement and construction Contracts (or drafts thereof, in the case of EPC Agreements that have not been executed before the Closing Date) for each Remaining 2017 Project included in the Remaining 2017 Project Budget, copies of which have been made available to Parents prior to the Effective Date or, solely with respect to Contracts that have not been entered into by the Effective Date, have been approved by Parents pursuant to Section 5.01(a) to the extent required thereunder.

EPC Agreements means the EPC Contract and the EPC Guarantee.
