Environmental Liability Cap definition

Environmental Liability Cap has the meaning specified in Section 10.6.
Environmental Liability Cap means an amount equal to the sum of (i) $20,000,000, (ii) the amount of any Environmental Liabilities associated with the J▇▇▇▇▇▇ ▇▇▇▇▇▇ landfill site and (iii) Boiler No. 4 Environmental Costs, but, in any event, not more than $25,000,000, in the aggregate with respect to clauses (i), (ii) and (iii).

  • Seller's liability for indemnification under this Section 6.5(a) is not subject to the Environmental Liability Cap, the General Liability Cap, or any deductible.
