Environmental Fee definition

Environmental Fee means the fee established to provide for the costs of administering programs for the reduction, reuse and recycling of waste produced by littering, failing to reuse or recycle or other actions or inactions by individuals;
Environmental Fee is defined in Section 18.2.
Environmental Fee means a fee charged by the City of Gary to cover the cost of GaryDepartmentof Environmental Affair and Green Urbanism’sinspection ofcontractualtowyards for proper disposal of Hazardous Materials.

Examples of Environmental Fee in a sentence

  • In circumstances in which there is a dispute whether MPC or Gateway is responsible for all or any portion of an Environmental Fee, the parties agree to negotiate a resolution of the dispute in good faith.

  • Where Interchange has reason to believe the Participant has over-remitted Environmental Fee to Interchange, then the Participant shall be reimbursed by Interchange as soon as practicable.

  • If the Participant is selling Material for use in a province with a similar program, the Environmental Fee is to be remitted to the local authority responsible for the similar program, as the case may be.

  • If the Participant is located in Yukon but sells or supplies Material to a ▇▇▇▇▇▇▇ that is located in another Canadian jurisdiction with a similar stewardship program to Interchange’s Stewardship Program, the Environmental Fee is to be remitted to the local authority responsible for the Material.

  • In the event of an audit the Participant shall make available to Interchange’s auditors any and all records relating to the sale and/or supply of those Materials for the Participant’s own use, sold or supplied in, or from a Participant outside of Yukon to someone in Yukon and remittances to Interchange of the Environmental Fee and shall provide to the auditor any information respecting transactions relating to Material, provided that such records are reasonably required to perform an accurate audit.

  • If the Participant is located outside of Yukon but sells or supplies Material to a Steward located in Yukon, the Environmental Fee is to be remitted to Interchange.

  • The Environmental Fee to be remitted by the Participant with respect to the use, sale or supply of Material shall be determined and from time to time amended by Interchange.

  • It is the intent of Interchange that the Environmental Fee in respect of a specific Material sold or supplied be paid only once.

  • If requested by Interchange, the Participant is to provide a record of all Environmental Fee sales and/or supplies of Material based on point of destination.

  • If the Rental Agreement includes an Environmental Fee, Customer shall pay same.

Related to Environmental Fee

  • Environmental Site Assessment means a Phase I environmental report meeting the requirements of the American Society for Testing and Materials, and, if in accordance with customary industry standards a reasonable lender would require it, a Phase II environmental report, each prepared by a licensed third party professional experienced in environmental matters.

  • Environmental Costs any and all costs or expenses (including attorney’s and consultant’s fees, investigation and laboratory fees, response costs, court costs and litigation expenses, fines, penalties, damages, settlement payments, judgments and awards), of whatever kind or nature, known or unknown, contingent or otherwise, arising out of, or in any way relating to, any actual or alleged violation of, noncompliance with or liability under any Environmental Laws. Environmental Costs include any and all of the foregoing, without regard to whether they arise out of or are related to any past, pending or threatened proceeding of any kind.

  • Lender’s Environmental Liability means any and all losses, liabilities, obligations, penalties, claims, litigation, demands, defenses, costs, judgments, suits, proceedings, damages (including consequential damages), disbursements or expenses of any kind or nature whatsoever (including reasonable attorneys’ fees at trial and appellate levels and experts’ fees and disbursements and expenses incurred in investigating, defending against or prosecuting any litigation, claim or proceeding) which may at any time be imposed upon, incurred by or asserted or awarded against the Administrative Agent, any Lender or any Issuer or any of such Person’s Affiliates, shareholders, directors, officers, employees, and agents in connection with or arising from:

  • Environmental Liabilities means all liabilities, monetary obligations, losses, damages, costs and expenses (including all reasonable fees, disbursements and expenses of counsel, experts, or consultants, and costs of investigation and feasibility studies), fines, penalties, sanctions, and interest incurred as a result of any claim or demand, or Remedial Action required, by any Governmental Authority or any third party, and which relate to any Environmental Action.

  • Material Environmental Amount an amount payable by the Borrower and/or its Subsidiaries in excess of $5,000,000 for remedial costs, compliance costs, compensatory damages, punitive damages, fines, penalties or any combination thereof.
