Except as otherwise expressly provided herein, each party hereto shall pay all of its own costs and expenses incurred or to be incurred in negotiating and preparing this Agreement and in closing and carrying out the transactions contemplated by this Agreement; provided, Sellers shall be liable to pay all costs and expenses incurred in connection with the preparation and delivery of the ENVIRON Report.
The ENVIRON Report identifies on page five certain recommended remedial work concerning chemical use and storage on the Japhet Property.
