The Agency Head shall examine the material and may, in his or her discretion, convene an informal conference with the Contractor and the ACCO and, in the case of construction or construction-related services, the City Engineer, City Resident Engineer, City Engineering Audit Officer, or other designee of the Agency Head, to resolve the issue by mutual consent prior to reaching a determination.
The CDRB shall send a copy of its decision to the Contractor, the ACCO, the Corporation Counsel, the Comptroller, the CCPO, and, in the case of construction or construction-related services, the City Engineer, City Resident Engineer, City Engineering Audit Officer, or other designee of the Agency Head.
Prior to the expiration of the Warranty Period and before the Security will be released by the City, a punch list of items to be repaired or replaced will be given to the Developer by the City and those items shall be completed to the satisfaction of the City Engineer, City Planner, City Clerk, and the City Manager.
Within thirty (30) Days after receipt of the complete Notice of Dispute, the ACCO or, in the case of construction or construction-related services, the City Engineer, City Resident Engineer, City Engineering Audit Officer, or other designee of the Agency Head, shall submit to the Agency Head all materials he or she deems pertinent to the dispute.
During such time as any dispute is being presented, heard, and considered pursuant to this Section, the Agreement terms shall remain in full force and effect and, unless otherwise directed by the ACCO or Engineer, the Contractor shall continue to perform work in accordance with the Agreement and as directed by the ACCO or City Engineer, City Resident Engineer, City Engineering Audit Officer, or other designee of the Agency Head.

All improvements and other work required by the plans referred to in this section and such other work as is required by the Delano City Code, City Engineer, City Planner, City Building Official and Delano Water, Light & Power Commission are hereafter referred to as the “Development Work.” Developer shall be responsible for all costs related to the Development Work.
