Endemic Failures definition
Endemic Failures means any failure and/or malfunction of any component and/or system and/or part and/or software which occurs:
(i) on at least ten percent (10%) of all such components and/or systems and/or parts and/or software of all Units ordered under the same Purchase Order (as applicable); or .
(ii) at least three (3) times on the same component and/or system and/or part and/or software, within the Warranty Period in Section 18.4.2 below, as a result from defect(s) of the same root cause in design, material, workmanship, and/or manufacturing process.
