ENCUMBERED SPACE definition

ENCUMBERED SPACE means space being used by Landlord or the ---------------- Building's manager, or is subject to a lease, option to lease, preferential right to lease (i.e., right of refusal, right of opportunity, or right of first offer), Letter of Intent, or otherwise encumbered and is not subject to Active Lease Negotiations (provided, however, that upon the cessation of such use by Landlord or the Building's manager, or the lapse, expiration, or termination of any such lease, option to lease, preferential rights to lease or other encumbrance, or the expiration or termination of a Letter of Intent unless a lease is entered into between the parties thereto or their affiliates, such space shall no longer be a part of the Encumbered Space, but shall instead be a part of the Available Space).
