As consideration for this Emergency Access Easement, Grantee shall compensate Grantor by installing, maintaining, and paying any annual fee required, at Grantee’s sole expense, a public electric vehicle charging facility within the Parking Lot.
This Amended Agreement and Emergency Access Easement shall commence upon the recording of this Amended Agreement with the Whatcom County Auditor.

Tenant also consents to, and shall not interfere with, the use by the occupants of and/or the owners of the Adjacent Property of the Emergency Access Easement (as defined in the CC&R’s) located on the Premises to the extent required by law or for safety and/or emergency access, provided such occupants and owners use the Emergency Accessways in accordance with the CC&R’s.
Notwithstanding the foregoing, Grantor shall not have any right to terminate the Emergency Access Easement for any reason.
The Owners shall be obligated to maintain in good condition and repair and in compliance with Applicable Laws all Easement Areas and any improvements, fixtures, equipment and other facilities installed thereon in connection with this Easement; provided however, the Owners shall only be required to perform the minimum maintenance necessary to ensure that the Emergency Access Easement Area is passable by motorized vehicles.
Grantor hereby grants, conveys, remises and releases unto the Village, its successors and assigns forever, a perpetual, irrevocable, non-exclusive easement and right-of-way (the "Emergency Access Easement") on, over, across and through the Emergency Access Easement Area for the Village, the County of Westchester (the "County"), the State of New York and any and all other official emergency vehicle ingress and egress between North Avenue and the Housing Company Property.

Together with appurtenant rights under the sewer line easement, water line easement and access easement granted under the Declaration and Deed of Easement, dated March 29, 1990 and recorded in Deed Book 3846, Page 324, and Together with non exclusive rights under emergency access easement granted under Deed of Emergency Access Easement dated May 12, 1998 and recorded in Deed Book 4513, Page 16.
