Interconnection Customer may assign its rights to the transmission rate credits to any person which qualifies as an Eligible Customer for Point-to-Point Transmission Service under Transmission Provider’s Tariff or takes transmission service from Transmission Provider under a grandfathered agreement executed with Transmission Provider prior to August 7, 2001, when Transmission Provider’s Tariff was first adopted.
Developer shall mean an Eligible Customer developing a Large Generating Facility, proposing to connect to the New York State Transmission System, in compliance with the NYISO Minimum Interconnection Standard.
Such confirmation from the Eligible Customer will indicate also when Supplier shall start delivery of Energy at the Delivery Point.
The DSO and Supplier shall cooperate to resolve the dispute and respond to the Eligible Customer setting forth what adjustment will be made, or the basis for the refusal to make an adjustment, within 15 days following the receipt of the written communication from the Eligible Customer.
Supplier acknowledges and agrees that the Municipality is not responsible to provide, and shall not be liable to Supplier or any Eligible Customer for any failure to provide, any Services pursuant to this Agreement.
