Electronic Note definition

Electronic Note means an electronically created note; (3) “Electronic Record” means a Record created, generated, sent, communicated, received, or stored by electronic means; (4) “Electronic Signature” means an electronic symbol or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign a record; (5) “E-SIGN” means the Electronic Signatures in Global and National Commerce Act, codified at 15 U.S.C. §7001 et seq., as it may be amended from time to time, or any applicable additional or successor legislation that governs the same subject matter; (6) “Note Holder Registry” means a registry system that is used to record the issuance and transfer of Electronic Notes; (7) “Paper Note” means an Electronic Note that is converted into a paper note; (8) “Record” means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form; (9) “Transferable Record” means an Electronic Record that: (i) would be a note under Article 3 of the Uniform Commercial Code if the Electronic Record were in writing and (ii) I, as the issuer, have agreed is a Transferable Record; and (10) “UETA” means the Uniform Electronic Transactions Act, as enacted by the jurisdiction in which the property is located, as may be amended from time to time, or any applicable additional or successor legislation that governs the same subject matter.
Electronic Note means an electronic record evidencing a Financed Federal Loan that contains terms substantially the same as the Financed Student Loan in a form complying with the applicable requirements of the Electronic Signatures in Global and National Commerce Act, 15 U.S.C.A. §§ 7001, et seq., the Uniform Electronic Transaction Act, as adopted in relevant jurisdictions and the Higher Education Act regarding electronic promissory notes.
Electronic Note or “eNote” means an Electronic Record under the ELECTRONIC SIGNATURES IN GLOBAL AND NATIONAL COMMERCE ACT (E-SIGN) and the UNIFORM ELECTRONIC TRANSACTIONS ACT (UETA) that:

  • If and to the extent that a Mortgage Note is an electronically signed document, then in lieu of delivery or endorsement of the Mortgage Note to the Trustee or Custodian, all necessary steps will be taken on the applicable Electronic Note Registry System for the Trustee to be considered in control of that Mortgage Note.
