  • Notwithstanding the Commissioning of any New Project, the Developer will retain title to and ownership of all Equipment, and the Project Company shall have the right to use such Equipment for the Term to generate electricity (and related environmental attributes) for sale under Subsequent Electricity Sales Agreements for so long as such Project Company remains in compliance in all material respects with the material terms of this Agreement applicable to it.
