Elective Design Changes are defined as any aesthetic or technologic upgrade to the project’s design or engineering, which upgrade is not necessitated from an engineering or cost-savings standpoint (e.g., design changes for aesthetic improvement purposes such as landscaping or lighting). Elective Design Changes specifically include the costs of any design or engineering changes necessitated by or resulting from the upgrade, including costs of design or engineering changes that flow into a non-requesting Party’s jurisdiction.
