With respect to any individually identifiable health information, the Parties agree to comply with the privacy and security requirements of HIPAA, the Health Information Technology for Economic and Clinical Health Act (the “HITECH Act”), and all other federal and state privacy and security laws applicable to the exchange and use of the EHR System Data.
Participant’s and Users’ Access to the EHR System Data shall be in accordance with the minimum necessary standard set forth in 45 C.F.R. Sections 164.502(b) and 164.514(d) and only as is appropriate to Users’ responsibilities.
HSHS shall provide Participant audit information to Participant regarding its Users’ Access, use, and disclosure of EHR System Data and EpicCare Link.
PROVIDER represents and warrants that it has the right to make the EHR System Property available to PARTICIPANT in accordance with the terms of this Agreement.
PARTICIPANT may use the EHR System Property only in accordance with the terms of this Agreement and applicable laws and regulations to create, access and share electronic medical record information and to employ related functionalities and support tools incorporated into the EHR System Property.
For greater certainty, a Viewing HIC collects Personal Health Information that is in the EHR System the first time that any of its agents view the Personal Health Information, even if the Viewing HIC’s agents do not download or otherwise make or retain a copy of the Personal Health Information.
The Program Property and the PROVIDER Property are collectively referred to herein as the “EHR System Property”; The EHR System Property is an electronic medical record solution that permits users to create electronic medical records, to access electronic medical records created by other users of the EHR System Property and to share electronic medical records with other parties for appropriate purposes.
In the event that the Contributor becomes aware that any of the Contributor Data in the EHR System is or has become inaccurate, corrupted, damaged or incomplete, and the EHR Data-In Interface does not support replacement of that Contributor Data, the Contributor will notify eHealth Ontario as soon as reasonably possible in accordance with the terms and conditions of this Agreement.
PARTICIPANT has no right, title or interest in the EHR System Property other than the rights and interests set forth in this Agreement.
This allows PROVIDER time to work with PARTICIPANT to build the necessary system definitions to properly install the EHR System Property.
