Eagle Qualified Plan definition
Eagle Qualified Plan shall have the meaning given to that term in Section 3.2(r)(6).
Eagle Qualified Plan means any Eagle Plan which is an employee pension benefit plan as defined in Section 3(2) of ERISA and which is intended to meet the qualification requirements of the Internal Revenue Code, as amended (the "Code"), (iii) Eagle Title IV Plan. The term "Eagle Title IV Plan" means any Eagle Qualified Plan that is a defined benefit plan (as defined in Section 3(37) of ERISA) and is subject to Title IV of ERISA.

There are no facts or circumstances that may adversely affect the qualification of any Eagle Qualified Plan.
