Subject to Exhibit E, Customer may connect --------- its system or other fiber optic systems controlled by it with the IRU Fibers at Customer's sole cost, at a Connecting Point at any optical amplifier, regenerator or junction site or other splice points agreed to by EBS, which agreement will not be unreasonably withheld or delayed; provided, however, any connection requiring a splice to be entered -------- ------- shall be performed by EBS at Customer's sole expense.
In addition, as (i) Customer E, Customer F and Customer K are associated with Customer A with the same beneficial owners; (ii) one of the ultimate beneficial owners of Customer A, Customer E, Customer F and Customer K is an associate of Customer B and Customer C; (iii) Customer B is an associate of Customer C; and (iv) Customer C is the ultimate beneficial owner of Customer G and Customer I, the grant of the Loan and the Existing Loans requires aggregation under Rule 14.22 of the Listing Rules.
E) Customer is solely responsible for any equipment, facilities and/or other materials used in connection with the Edge ADN Service which are not provided by COMPANY, including any related applications, systems and software.
For zones A, C, D & E, Customer will pay a range of rates from $0.0285 to $0.2700 for Local Toll and Local Freephone access.
