The General Partner is hereby authorized to cause the Partnership to issue Partnership Units designated as Class A Units, Class AX Units, Class D Units, Class DX Units, Class I Units, Class IX Units, Class P Units and Class PX Units.
Notwithstanding the foregoing representation, Customer may contract freely with respect to the optional Street Lighting project, referenced in Section 3(a), above, and for that portion of the Scope of Services relating to ECM 5 (HVAC DX Units Retro-commissioning at Stamford Government Center) for which an allowance is included in the Contract Cost set forth in Section 3(a), above.
Subject to the provisions of Article 4 hereof all such electric energy shall be furnished to Tenant at Tenant’s cost and expense, and Tenant shall cause all the DX Units exclusively serving the demised premises to be connected to the direct meter(s) (or submeter(s) if applicable) measuring Tenant’s consumption of electricity.
Landlord shall furnish, at Tenant's expense in accordance with Section 7.01D, to the DX Units, through the distribution facilities to be installed by Landlord in the Building, alternating electric current in a type and amount required to operate the DX Units serving the floor of the Premises.
Tenant agrees that the base Building DX Units serving the demised premises shall contribute the proportionate share of ventilated air and air-conditioning to the common areas of the floors on which the demised premises is located.
During the hours of 8:00 a.m. to 8:00 p.m. on weekdays and Saturdays 9:00 a.m. – 1:00 p.m., holidays excepted (the “HVAC Business Hours”), Tenant shall control the temperature within the Premises via the DX Units.
Subject to the other provisions of this Article 7, Landlord shall furnish to the Premises, beginning upon the Commencement Date, through the distribution facilities serving the Building, an electricity demand load of seven (7) ▇▇▇▇▇ per usable square foot, exclusive of electricity required to operate the base Building systems (including the HVAC System, both in the central plant and to the DX Units).
Landlord has informed Tenant that the windows of the demised premises and the Building are sealed, and that the demised premises may become uninhabitable and the air therein may become unbreatheable during the hours or days when Landlord is not able to furnish condenser water to the demised premises or when the DX Units are not operational.
If applicable through Tenant’s expansion, Landlord shall be responsible for the maintenance and repair of the base Building DX Unit(s) serving the 2nd Floor Expansion Space, the 6th Floor Expansion Space and any Offer Space.
Landlord shall furnish to the Premises DX Units through the distribution facilities installed by Landlord in the Building, alternating electric current in a type and amount required to operate the DX Units.
