DWR Contract definition

DWR Contract means, collectively, (a) the Master Power Purchase and Sale Agreement made as of March 23, 2001 between Allegheny Trading Finance Company, a Delaware corporation (as assignee of AESC), as Party A thereunder, and California Department of Water Resources, as Party B and (b) the Master Power Purchase and Sale Agreement made as of April 20, 2001 between Allegheny Trading Finance Company, a Delaware corporation (as assignee of AESC), as Party A thereunder, and California Department of Water Resources, as Party B.
DWR Contract means, collectively, (a) the Master Power Purchase and Sale Agreement made as of March 23, 2001 between ATF (as assignee of the Borrower), as Party A thereunder, and California Department of Water Resources, as Party B and (b) the Master Power Purchase and Sale Agreement made as of April 20, 2001 between ATF (as assignee of the Borrower), as Party A thereunder, and California Department of Water Resources, as Party B.
DWR Contract means, collectively, (a) that certain Master Power Purchase and Sale Agreement comprised of (i) the EEI form of Master Power Purchase and Sale Agreement (Version 2.1; modified 4/25/00) and (ii) a Cover Sheet thereto dated as of February 6, 2001, as amended and restated on February 26, 2001, as further amended and restated on April 22, 2002 (collectively, the "Master Purchase and Sale Agreement"), (b) that certain Master Power Purchase and Sale Agreement Confirmation Letter (Peaking Capacity), dated as of February 27, 2001, as such confirmation letter was amended and restated on April 22, 2002, by that Master Power Purchase and Sale Agreement Amended and Restated Confirmation Letter for 495MW for the period ending July 31, 2011, commonly referred to as "Calpine 3", in each case between Issuer (as assignee to Calpine Energy Services) and DWR and (c) that certain letter agreement dated as of July 21, 2003, between Issuer (as assignee to Calpine Energy Services) and DWR; provided that, for the avoidance of doubt, the term "DWR Contract shall not include (i) any confirmation letter entered into between Calpine Energy Services and DWR other than the confirmation letter expressly referenced in (b) above (the "Calpine 3 Confirmation") or (ii) the Master Purchase and Sale Agreement except to the extent that it applies to the Calpine 3 Confirmation.

  • INVOICING AND PAYMENT Contractor shall submit three copies of the invoice to the State only after receiving written notice of satisfactory completion or acceptance of work by the DWR Contract Manager.

  • If Utility or DWR Contract resource capacity is used for ancillary services, the capacity quantity will not be included in the supply quantity of the owning party for the purpose of pro rata share calculations, and owning party will retain all the revenues from the ancillary services as well as all associated transaction costs and ISO charges.

  • In the event the Contractor is unable to perform commissioned services because of problems relating to quality, quantity, delivery schedule, or for any other reason, the Contractor must immediately notify the DWR Contract Manager.

  • In accordance with Section 10 (“Invoicing”) of this Agreement, DWR will pay Yuba within sixty days of the date that both the DWR Contract Manager and the Accounting Office receive the appropriate invoices and verification that the amount of Component 4 Water specified therein has been scheduled in accordance with Section 9 ("Scheduling of Water") of this Agreement.

  • Work will begin based on work dates provided by the DWR Contract Manager.

  • Contractor and DWR agree that the services delivered under Work Order No. [xx] will be performed in accordance with the terms and conditions of DWR Contract No. 4600010[xxx], as amended.

  • DWR will pay Yuba within sixty days of the date that both the DWR Contract Manager and the Accounting Office receive invoices containing all of the information required by Section 10(B) of this Agreement.

  • Fencing will be Ameristar, Aegis II, industrial strength CLASSIC panel or a comparable material approved by the DWR Contract Manager.

  • A job walk can be requested for any complex projects that it is deemed necessary by the Contractor or the DWR Contract Manager.
