Dual Source definition

Dual Source or “Dual Sourcing” means selling, offering for sale, or distributing two or more units of a Customer Product, some of which are manufactured from Respondents’ PEEK and some of which are manufactured from Competing PEEK.
Dual Source or “Dual Sourcing” means selling, offering for sale, or distributing two or more units of a Customer product with the same product name and part number, some of which are manufactured from Invibio PEEK and some of which are manufactured from Competing PEEK.

  • Neither Purchaser nor HPG shall be deemed to be in breach of any Sole Source Award or Dual Source Award terms of this Agreement (if any) as a result of the purchase of replacements for Product that Vendor is unable to provide as required by the terms of this Agreement.

  • In addition to any other rights or remedies of Division, if the award basis is Sole Source or Dual Source, upon any such breach, Division shall have the right, by providing fifteen (15) calendar days’ notice to Vendor, to either: (i) convert such Sole Source Award or Dual Source Award designation to an Optional Source Award designation for such Product, with no change in pricing from the Sole Source Award or Dual Source Award pricing; or (ii) terminate this Agreement.

  • In addition to any other rights or remedies of HPG, if the award basis is Sole Source or Dual Source, upon any such breach, HPG shall have the right, by providing fifteen (15) calendar days’ notice to Vendor, to either: (i) convert such Sole Source Award or Dual Source Award designation to an Optional Source Award designation for such Product, with no change in pricing from the Sole Source Award or Dual Source Award pricing; or (ii) terminate this Agreement.

  • Upon fifteen (15) calendar day notice, HPG shall have the right to convert any Sole or Dual Source Product designation in this Agreement to a "Optional Source" designation, with no change in pricing from the Sole or Dual Source pricing, if Vendor fails to maintain at least a 95% fill rate for all Products for all Purchasers.

  • Additionally, if this is a Dual Source Award and the other Dual Source Award supplier is unable to supply its product, then neither Division or any Purchaser shall be deemed to be in breach of any terms of this Agreement as a result of the purchase from a third party supplier of replacements for product that the other Dual Source Award supplier is unable to provide (or any Distributor of such other supplier is unable to supply due to such supplier’s supply problems).

  • Upon fifteen (15) calendar days notice, HPG shall have the right to convert any Sole or Dual Source designation for any Product in this Agreement to an “Optional/Preferred Source” designation, with no change in pricing from the Sole or Dual Source pricing, if Vendor fails to maintain at least a ninety-five percent (95%) fill rate for all purchases of such Product by all of the Purchasers.

  • HPG shall offer Vendor equal consideration and review for potential supply commitments for New Technology Products on a Dual Source basis.

  • It believes that its Dual Path Unit Ventilator/EER+ System, currently in development, and other products using its leading edge patented Dual Source technology and Dual Coil technology, for which a patent is pending, will enable GEER to generate revenues of about $115 million by year five and a p▇▇▇▇t in the second year of operations.

  • First Tier Reseller is in the business of distributing products to and supporting selling locations owned and operated by HP Authorized VARs, Second Tier Resellers who have selected First Tier Reseller as one of their Dual Source Suppliers and resellers who are not authorized directly by HP but who are permitted to resell HP Products as described in this Agreement.

  • Additionally, if this is a Dual Source Award and the other Dual Source Award supplier is unable to supply its product, then neither HPG or any Purchaser shall be deemed to be in breach of any terms of this Agreement as a result of the purchase from a third party supplier of replacements for product that the other Dual Source Award supplier is unable to provide (or any Distributor of such other supplier is unable to supply due to such supplier’s supply problems).

Related to Dual Source

  • Virtual source means a point from which radiation appears to originate.

  • Referral Source has the meaning set forth in Section 7.07(b).

  • Commercial Software means Software developed or regularly used that: (i) has been sold, leased, or licensed to the general public; (ii) has been offered for sale, lease, or license to the general public; (iii) has not been offered, sold, leased, or licensed to the public but will be available for commercial sale, lease, or license in time to satisfy the delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or (iii) above and would require only minor modifications to meet the requirements of this Contract.

  • Short-rotation coppice means a specific management regime whereby the poles of trees are cut every one to two years and which is aimed at producing biomass for energy. It is exempt from the UK government timber procurement policy requirements and falls under agricultural regulation and supervision rather than forestry. The exemption only refers to short-rotation coppice, and not 'conventional' coppice which is forest management and therefore subject to the timber policy.

  • Licensed clinical social worker means an individual who meets the licensed clinical social worker requirements established in KRS 335.100.
