Draw Cap definition

Draw Cap means the maximum principal amount that may be funded under this Note. The Draw Cap is not a commitment from Lender. Lender may, in its sole discretion, elect not to fund any Draw request for any reason or no reason.

Examples of Draw Cap in a sentence

  • Customer may not draw more power than the Qty/kVA or kW amount listed on the Order (Draw Cap).

  • If Customer exceeds the Draw Cap, Verizon will notify Customer and Customer must reduce power draw to be equal to or less than the Draw Cap within 72 hours (or as otherwise agreed) or Verizon may, in its sole discretion, either charge Customer for the power overage at twice the then-current MRC/kVA rate for Licensed Space and power, or suspend Customer's power to return to Draw Cap compliance.

  • If Customer exceeds the Draw Cap, Verizon will notify Customer and Customer must reduce power draw to be equal to or less than the Draw Cap within 72 hours (or as otherwise agreed) or Verizon may, in its sole discretion, either charge Customer for the power overage at twice the then- current MRC/kVA rate for Licensed Space and power, or suspend Customer's power to return to Draw Cap compliance.

  • Customer will pay the Charges incurred for Colocation Services which will include any fees arising from (i) overages or power usage that exceeds the Draw Cap, (ii) requests submitted through a Customer Care Website, (iii) remote hands support requested or required (including as a result of a trouble ticket submitted by Customer), (iv) a disconnect or deinstall, (v) selections of redundancy and diversity and (vi) any substitution or change (such as the replacement of a Cross Connect).

  • Additional amounts, up to the Draw Cap, shall be funded by Lender on 2 business days written notice from the Company, which notice shall be accompanied by a certificate evidencing that the Class A Preferred Directors approved the aggregate borrowing amount and stipulating the Lender’s pro rata share and providing wire transfer or other funding instructions.

  • Subject to the Infinet Draw Cap, at any time prior to the occurrence of an Event of Default, Borrower may request, pursuant to a written notice delivered by Borrower to Agent (“Infinet Request”), that Agent instruct Cash Management Agent to wire an amount to Infinet as set forth in such written notice.
