DOD Contract definition

DOD Contract means Contract No. W9113M-04-D-0002, dated January 3, 2004, between U.S. Army Space and Missile Defense Command and Borrower, as it has been and in the future is amended.
DOD Contract means the DOD Application Form along with the incorporated documents that form the terms of the contractual agreement between DOD and the Company.
DOD Contract means that certain Strategic VAR Agreement between Netscape and Intelligent Decisions, Inc. dated as of November 28, 2001 relating to Sellers’ products and services provided to the Department of Defense as the same may be extended or renewed, (y) any new agreement between Buyer and Intelligent Decisions or any other reseller or directly or indirectly with the Department of Defense or any of its associated agencies for Buyer to provide products, services or software based upon, incorporating or including any Customer Deliverables or any portion thereof (“Buyer Customer Deliverables”) or (z) any existing agreements, or extension or renewal thereof, between Buyer and the Department of Defense or any of its associated agencies or any reseller to the Department of Defense or any of its associated agencies pursuant to which Buyer sells Buyer Customer Deliverables; and “Revenue Bookings” shall mean the purchase price for Buyer Customer Deliverables purchased pursuant to DOD Contract that are for software licenses for orders placed on or before April 30, 2005, and the aggregate fees for services to be performed within one year of the effective date of any order related to Buyer Customer Deliverables for orders placed on or before April 30, 2005, in each case which the contracting party will be obligated to pay to Buyer as consideration for Buyer’s performance thereunder.

  • If this product is acquired under the ter ms of a (i) Civilian Agency Contract - use, reproduction or disclosure is subjec t to FAR 52.227-19(a) through (d) and restrictions set forth in the accompanying end user agreement; and (ii) DOD Contract - use, duplication or disclosure by t he Government is subject to the terms of this license unless superseded by 252.2 27-7013(c)(1)(ii).

  • If For Official Use Only information is provided to a contractor, specific notification of the requirements for protection of such information must be provided to the contractor as a contractual requirement other than the DD Form 254 (DOD Contract Security Classification Specification).

  • Such records and information shall include at a minimum all invoices for payment submitted by the DOD to the Company along with complete supporting documentation and all records and information related to the execution or performance of DOD Contract.

  • If Buyer does not pay Sellers the Additional Consideration, Buyer must permit an independent auditor selected by Sellers, upon reasonable prior notice, to examine the records relating to Revenue Bookings and the DOD Contract.
