Disputing Claimant definition

Disputing Claimant means a Holder of an Investor Principal Claim that has disputed the amount set forth on such Holder’s Ballot by checking the “dispute” box in accordance with the procedures set forth in the Disclosure Statement Order and applicable Ballot until such dispute is resolved by a compromise and settlement or Final Order.

Examples of Disputing Claimant in a sentence

  • The Disputing Claimant shall bear his own costs incurred in relation to the proceedings before the Dispute Committee, including, without limitation, any costs of legal representation or assistance.

  • Notwithstanding the previous sentence, upon finding that the Disputing Claimant’s claim has merit, the Dispute Committee may decide, in its sole discretion, that the Foundation must compensate the Disputing Claimant for reasonable costs incurred in relation to the proceedings before the Dispute Committee, including, for example, costs of an interpreter, costs for the translation of documents or evidence or travel costs, but excluding any costs of legal representation or assistance.
