Disposed Material definition
Disposed Material means and include any material that (a) actually consumes permitted airspace or volume at the Landfill, as applicable, including cover or fill that is stored for later use, and (b) generates cash revenue for the OPERATOR. Payments of such Fees shall be made on a quarter-annual basis. Such Fees are in the nature of general revenues, and are not a fee, tax, or surcharge with regard to the permanent disposal of solid waste to be utilized for solid waste management purposes, but, rather, are general revenue fees which are to be collected under this Agreement in addition to any and all such other solid waste management/disposal fees, assessments and/or levies required by any state and/or local governmental entities.
