Disposable Product(s) definition

Disposable Product(s) means textile products designed to be used once only or for a limited time, and the normal use of which precludes any restoring for subsequent use for the same or a similar purpose.
Disposable Product(s) means products that are intended or expected to be used only one time that are either S&N branded disposable equipment or disposable equipment purchased from S&N for resale under any trademark, tradename or brand name approved by S&N and that have instructions for use primarily intended for producing (in conjunction with Hardware Products) or applying compositions consisting of platelets or platelet releasate (which includes, but is not limited to, platelet concentrate or platelet rich plasma (“PRP”)) to facilitate the healing of wounds or other damaged tissue. Disposable Products do not include, for example, items such as syringes, needles, cell washing bowls, catheters, gauze or other forms of dressing, gloves, etc. that are not sold within a platelet or PRP-related kit. Any Licensee product which is marketed by Licensee without direct or indirect reference to platelets or platelet releasate, and which is not otherwise covered by the Licensed Patents, shall not be considered a Disposable Product. For the term of this Agreement, the items listed in Exhibit B will be considered Disposable Products irrespective of the Licensee’s marketing activities thereon. S&N reserves the right to supplement the items listed in Exhibit B.
Disposable Product(s) shall have the meaning set forth in Schedule A, attached hereto.

Examples of Disposable Product(s) in a sentence

  • Cardinal Health acknowledges that Disposable Products are also subject to acceptance or rejection by Customers, and will promptly following any Customer rejection, (i) cause the rejected Disposable Products to conform or (ii) deliver to SRI new Disposable Products that conform to the order.

  • For the avoidance of doubt, Cardinal Health shall, during the term of this Agreement, remain SRI’s exclusive supplier of the Disposable Products for sale to the SRI Legacy Customers regardless of the amount of Total Revenues.

  • The products covered by this Article are the Disposable Products.

  • If SRI properly rejects any Disposable Products as nonconforming, Cardinal Health, at its sole cost and expense, as soon as practicable after the effective date of SRI’s notice of rejection, shall either (a) cause the rejected Disposable Products to conform or (b) deliver to SRI new Disposable Products that conform to the order.

  • The Disposable Products shall be labeled with a co-branded label mutually agreed to by the parties and substantially in the form attached hereto as Annex A.

  • Cardinal Health hereby appoints SRI as a non-exclusive distributor of the Disposable Products in the Territory and SRI accepts such grant for the term and on the conditions stated in this Agreement.

  • Customer represents and warrants that the Equipment and Disposable Products are being acquired solely for the Customer’s own use at the Customer facility(ies) listed herein.

  • Except in the instance of (i) above, Disposable Products will only be considered for exchange or credit if the item is in its original packaging, with no visible marks or damage, and the sterile packaging remains uncompromised.

  • Any and all capital expenditures (excluding non-capacity capital expenditures such as maintenance and repair) required to enable Difco to manufacture up to 5,500,000 units of Bottle Disposable Products per year to fulfill AccuMed's requirements pursuant to this Agreement (which in all cases shall be subject to the forecasts pursuant to this Agreement) shall be borne by Difco.


More Definitions of Disposable Product(s)

Disposable Product(s) means the disposable products manufactured, sourced or supplied by Cardinal Health that a SRI Legacy Customer desires to purchase from SRI, including without limitation all disposable products that are purchased by a SRI Legacy Customer as of the Original Effective Date and, in the case of such disposable products that are not manufactured, sourced or supplied by Cardinal Health, all comparable products manufactured, sourced or supplied by Cardinal Health.
Disposable Product(s) means medical instruments and components of such medical instruments which may have one or more electrode(s) and electrical connection(s) for coupling the electrode(s) to a Controller(s).
Disposable Product(s) means either Medtronic branded disposable equipment or disposable equipment purchased from Medtronic for resale under a trademark, tradename or brand name of Medtronic having instructions for use primarily intended for producing (in conjunction with Hardware Products) or applying compositions consisting of platelets or platelet releasate (which includes, but is not limited to, platelet concentrate or platelet rich plasma ("PRP")) to facilitate the healing of wounds or other damaged tissue. Disposable Products do not include, for example, items such as syringes, needles, cell washing bowls, catheters, gauze or other forms of dressing, gloves, etc. that are not sold within a platelet or PRP-related kit. Any Licensee product which is marketed by Licensee without direct or indirect reference to platelets or platelet releasate, and which is not otherwise covered by the Licensed Patents, shall not be considered a Disposable Product. For the term of this Agreement, the items listed in Exhibit B will be considered Disposable Products irrespective of the Licensee's marketing activities thereon. Licensee reserves the right to add to the items listed in Exhibit B.
Disposable Product(s) means those products supplied by BTI and listed in Exhibit A which are necessary to perform high density microparticle cell separation procedures, specifically including depletion chambers, collection bags, connecting tubings and reagents.
Disposable Product(s) means equipment or products that are intended to be used only one time (and specifically excluding all [**]) which (A) are Harvest Branded or purchased from Harvest or one of its Affiliates for resale under a Harvest Brand and (B) are covered by a Claim of one or more Licensed Patents (or the manufacture, sale, offer for sale, or use of which infringe a Claim of one or more Licensed Patents, whether based on direct or contributory infringement, inducement to infringe or any other theory).   • Recyclable Product means the ability of a product and its packaging to be reused, reconditioned for use, or recycled through existing recycling collection programs.
