Discovering or “Discovery” means any and all research or discovery activities in respect of a Compound, Formulation, or Product.

Discovering means, among other things, “observing what was unknown hitherto”.5 Personally I prefer another, older definition of the concept of discovery i.e.: “concluding that something is as it is”.6 However, when does an insurer conclude that something is as it is, and that a fact has indeed been withheld?
