These positions will exist in the following programs: Autism Spectrum Disorders, CLASS, SPEN, SPAN, Federal Setting III and IV EBD programs, ECSE, D/HH, DCD, PHD, Hospital Agencies, Lifeskills, and Transition Plus.
Each SELPA shall have a designated person as a point of contact for students referred to the regional D/HH programs.
By signing this Agreement, the authorized representatives of DHH and the Data User agree to all of its provisions.

The district of service maintains the right to discipline a student enrolled in a regional D/HH program on the site as they would any other student enrolled in the district/school.
It is understood that the regional D/HH programs are hosted on district sites, and that the students enrolled in these programs are considered students of the district of service, and that the students are bound by the respective district/school handbook.
Company and Provider recognize and agree that in the event of termination of the State Contract between Company and DHH, Provider shall immediately make available to Company or its designated representative and to DHH or its designated representative, in a usable form, any and all records, whether medical or financial, related to Company’s and Provider's activities undertaken pursuant to this Agreement.
At Provider’s discretion, Provider may file a grievance on behalf of a Member; however, Provider shall adhere to the requirements and grievance and appeals procedures outlined by Company, CMS, DHH or other governmental body.
In addition, Provider is not permitted to encourage or suggest, in any way, that Members be placed in state custody to receive medical or specialized BHS covered by DHH.
