Examples of DFS Agreement in a sentence

  • Notwithstanding the provisions of any of the Ancillary Agreements, none of the Ancillary Agreements shall automatically terminate upon the purchase by Dell of the CIT Aggregate Interest pursuant to the terms of the DFS Agreement, but instead such agreements (including this Agreement) shall remain in effect to the extent necessary to enable CIT to exercise its CIT Minimum Funding Right on the same terms and conditions as contemplated in this Agreement.

  • The Parties agree that they will take such further actions and make such further amendments to the Ancillary Agreements (and related agreements, as applicable) as are necessary or appropriate to fully carry out and implement the intent of the various amendments included in this Agreement and the DFS Agreement.
