Development Common Areas definition

Development Common Areas means all those areas or parts of the Land and the Development the right to the use of which is designated for the common use and benefit of the Owners and occupiers of the Units and is not given by this Deed to the Owner of any individual Unit and which include, without limiting the generality of the foregoing, external walls of the Development (excluding all external walls forming part of the Residential Common Areas or the Residential Unit), site fence walls and entrance gates of the Development (excluding those forming part of the Residential Common Facilities), driveway (excluding those forming part of the Car Park Common Areas or the Residential Common Areas), emergency vehicular access (excluding those forming part of the Residential Common Areas), low voltage cable duct room(s), electric room(s), fire services & sprinkler pump room(s), fire services water tank(s), sprinkler tank(s), check meter cabinet(s), fire services sprinkler control valve room(s), master water meter room(s), Transformer Room Cable duct(s), caretaker counter(s), smoke vent(s), fire services control room, fire services inlets, low voltage cable duct(s), switch gear room(s), switch gear hoisting duct(s), Transformer Room hoisting duct(s), Transformer Room(s), flat roofs on the first and second floors of transformer building, switch room(s), roof of transformer building at top roof, staircases, emergency generator room(s), fuel tank room(s), management office, owners’ committee office, architectural features, site fence wall(s), sprinkler inlets cabinet(s), refuse chamber(s), telecommunication room(s), hard paved area(s), protected corridor(s), lawn(s) and such areas within the meaning ofcommon parts” as defined in Section 2 of the Ordinance but shall exclude the Car Park Common Areas and the Residential Common Areas. For the purpose of identification, the Development Common Areas are shown coloured Indigo on the plans certified as to their accuracy by or on behalf of the Authorized Person annexed hereto.
Development Common Areas means all those areas or parts of the Lot and the Development the right to the use of which is designated for the common use and benefit of the Owners and Occupiers of all the Units and is not given by this Deed or otherwise to the First Owner or an Owner of any individual Unit and is not otherwise specifically assigned other than to the Manager on trust for the benefit of all Owners and which include, without limiting the generality of the foregoing:-
Development Common Areas means the areas in the Development other than the buildings, the parking garages, the hotel and the marina.

Examples of Development Common Areas in a sentence

  • Tenant will not keep, use, sell or offer for sale in or upon the Premises any article which may be prohibited by any insurance policy periodically in force covering the Building or the Development Common Areas.

  • In determining whether increased premiums are a result of Tenant's use of the Premises, a schedule issued by the organization computing the insurance rate on the Building, the Development Common Areas or the Tenant Improvements showing the various components of such rate, will be conclusive evidence of the several items and charges which make up such rate.

  • Every Owner, his tenants, servants, agents, invitees and licensees shall have the full right and liberty (in common with the Manager and others having like rights) to go pass and ▇▇▇▇▇▇ over and along and to use the Development Common Areas and Facilities for all purposes connected with the proper use and enjoyment of the same.

  • Where there is a dispute on whether an area is to be regarded as Development Common Areas or Residential Common Areas or whether a facility is to be regarded as part of the Development Common Facilities or Residential Common Facilities, the decision of the Manager made in consultation with the Owners’ Committee shall be final and binding on all Owners save and except mistakes and errors.

  • Lessee will not keep, use, sell or offer for sale in or upon the Premises any article which may be prohibited by any insurance policy periodically in force covering the Building or the Development Common Areas.

  • The following rules and regulations govern the use of the Building and the Development Common Areas.

  • Tenant will not keep, use, sell or offer for sale in or upon the Premises any article which may be prohibited by any insurance policy periodically in force covering the Buildings or the Development Common Areas.

  • Landlord shall also repair at its sole cost and expense, any latent defects in the design or construction of the Project or Development Common Areas, any defects in the Improvements which constitute a breach of the one-year construction warranty provided by the Contractor who installs the Improvements or are not installed in accordance with the approved drawings, plans and specifications.

  • The Development is a mixed-use project to consist of buildings and uses up to the following sizes: a 100-room hotel; 20,000 square feet of retail space; 20,000 square feet of restaurant space; 430,000 square feet of Class A office building space; a 200-slip marina; and Development Common Areas.

  • All other areas of the Development, (exclusive of the Building Common Area as defined above) for joint use of all Tenants within the Development shall be known as Development Common Areas as shown on Exhibit "C" attached hereto and incorporated herein.


More Definitions of Development Common Areas

Development Common Areas means those parts of the Development as shown on the Ground Floor Plan, the 1st Floor Plan, the 2nd Floor Plan, the Roof Plan, the Lower Mechanical Floor Plan, the Upper Mechanical Floor Plan and the Elevations annexed to this Deed and certified as to the accuracy thereof by or on behalf of the Authorized Person and thereon coloured yellow and intended for the common use and benefit of the Owners and Occupiers of the Units including, but not limited to, certain entrances, exits, passageways, stairways, staircases, lift lobby on the 1st Floor, hose reel units, refuse storage and material recovery chamber, fire services inlet & sprinkler inlet, sprinkler control valves cabinet, water check meter cabinet, transformer room, loading and unloading space, the Accessible Carpark cum Visitor’s Carpark, turn table, electric vehicle charging meter room, towngas cabinet, telecommunications and broadcasting equipment riser duct, main switch room, sprinkler water tank, sprinkler water pump room, fire service water pump room, fire service water tank, fire service check meter cabinet, electric meter cabinets, telecommunications and broadcasting equipment rooms, transfer water pump room, potable & flushing water pump room, potable & flushing water tank room, fuel tank, emergency generator room, external walls on the Ground Floor and the 1st Floor (not forming part of any Unit and for the purposes of identification only are shown coloured yellow on the Elevations annexed to this Deed) and any other parts or spaces on or in the Land and the Development for the common benefit of the Owners and Occupiers of the Units and not for the exclusive use or benefit of the Owner or Occupier of any individual Unit EXCLUDING the Residential Common Areas and EXCLUDING any part, space, area or facility the exclusive right and privilege to hold use, occupy and enjoy the same that belongs to any particular Owner PROVIDED THAT, where appropriate, if (a) any parts of the Development covered by paragraph (a) of the definition ofcommon partsset out in Section 2 of the Ordinance or (b) any parts specified in the Schedule 1 to the Ordinance and included under paragraph (b) of the definition of “common parts” set out in Section 2 of the Ordinance, are also for the common use and benefit of all the Owners of the Units, such parts shall be deemed to have been included as, and shall form part of, the Development Common Areas;
