Developer or Owner definition

Developer or Owner s Engineer” means the registered professional engineer which is designated and retained by a developer or owner to design the proposed sewer system facilities in accordance with Ash Creek SSD’s rules and regulations.
Developer or Owner means any natural or legal person who is the end owner of the Works and Services and/or additional Goods and Products executed and/or supplied by the Subcontractor.
Developer or Owner means the persons, firm, governmental agency, or other entity on the application submitted and are responsible for compliance with the terms and conditions of this ordinance.

Examples of Developer or Owner in a sentence

  • Except as otherwise provided in Section 9.1 hereof, none of the responsibilities and obligations of Developer or Owner under this Agreement shall in any way or in any manner be deemed to create any liability of Developer or Owner to, or any rights in, any Person other than Owner or Developer.

  • The City will have the same ownership interest in any documents, plans, designs, renderings prepared, or services performed under the Scope of Work of this Agreement as the Site Developer or Owner shall have, including but not limited to any work completed or undertaken and not yet complete.

  • Developer or Owner, as applicable, shall regularly apprise the other of the status of all proceedings.

  • All persons employed by Developer in the performance of its responsibilities hereunder shall be the employees of Developer and not of Owner (provided that any independent contractors shall not be deemed employees of either Developer or Owner), and shall be exclusively controlled by Developer and not by Owner, and Owner shall have no liability, responsibility or authority with respect thereto.

  • Developer or Owner may submit its proposed bidding process to the City for review and approval or disapproval prior to receipt of any funds hereunder.

  • A standard Maintenance Plan and Agreement addressing buffer and landscaping maintenance shall be executed by Developer or Owner (as the case may be) prior to preliminary site and civil design plan approval.

  • If Developer or Owner fails to timely cure any item(s) of non-compliance set forth in a Notice of Breach, then the City shall have the right but not the obligation to initiate proceedings for the purpose of terminating this Agreement pursuant to Section 11.4 below.

  • The Developer or Owner, as applicable, may terminate this Agreement and the Developer or Owner will have no further obligations with respect to development of the Project.

  • The City shall from time to time, upon request made by Developer or Owner, meet with Developer/Owner and representatives of each of its Secured Lenders to negotiate in good faith any Secured Lender’s request for interpretation of any part of this Agreement.

  • This Agreement shall not be assigned or transferred by Developer or Owner without the prior written consent of the City; provided however, that this limitation shall not be construed to prohibit Developer from undertaking activities under this Agreement with the Owner meeting the requirements of Section 1(a) of this Agreement.
