Developer Delay definition

Developer Delay means any failure by Developer to complete one or more of its obligations under this Agreement in the manner and within the time period specified therefor in this Agreement; provided, however, that a City Delay shall not be deemed to cause a Developer Delay.

  • Developer shall develop and construct the Stadium Improvements in accordance with the terms and conditions of this Agreement and all Applicable Laws, and shall diligently and continuously adhere to the Stadium Construction Schedule (subject to any Excusable Developer Delay permitted in accordance with the terms of this Agreement) and the Plans for Stadium Improvements.

  • Upon the occurrence of any Authority Delay or Developer Delay, the Parties shall endeavor to continue to perform their obligations under this Agreement so far as reasonably practicable.
