Design Error definition

Design Error means: any non-compliance with this Agreement or applicable Laws; or any: error or omission in; or Discrepancy, incompleteness, lack of integration, lack of co-ordination or lack of detail within or between, any one or more of the Deliverables. Discrepancy includes any omission, discrepancy, ambiguity, fault or inconsistency. Dispute has the meaning given to that term in clause 17.1.
Design Error means a Wrongful Act but does not include any actual or alleged negligence in the review of shop drawings and submittals, issuance of change orders, observation of construction or review of any contractor’s request for payment.

Related to Design Error

  • Design Manual means the MOHLTC design manual or manuals in effect and applicable to the development, upgrade, retrofit, renovation or redevelopment of the Home or Beds subject to this Agreement.

  • Design-build team means an entity that consists of:

  • Design-Builder means the Person/Firm(s)/Joint Venture selected pursuant to the RFP that enters into the Contract with the Department to design and construct the Project.

  • Design flow means the average annual flow or average daily flow specified in an approved facilities plan or approved plans and specifications, the flow specified in a WPDES permit, or the flow required to meet performance standards.

  • Design engineer means a person professionally qualified and duly licensed in New Jersey to perform engineering services that may include, but not necessarily be limited to, development of project requirements, creation and development of project design and preparation of drawings and specifications.
