Derivative Use definition

Derivative Use includes the right to use, execute, display, perform or reproduce the subject Technology, and the right to modify or prepare derivative works based on such Technology, but excludes any right to distribute, license, sublicense, sell or otherwise transfer or make available such Technology to any third party.

  • Captive User means the end user of the electricity generated in a Captive Generating Plant and the term “Captive Use” shall be construed accordingly;
