Deposit #2 and together with Deposit 1, the “Deposit”). If the sale is not consummated because of B▇▇▇▇’s default hereunder, $250,000 shall be paid to Seller as liquidated damages and not as a penalty, from the Deposit, and the balance of the Deposit shall be returned to the Buyer.

  • Deposit Taker means the licensed deposit taker detailed in the relevant Addendum.
