Deployed Funds definition
Deployed Funds means, in any period, the aggregate funds that have been advanced by NYGB pursuant to the terms of executed investment and financing agreements which remain in force during that period, expressed in dollars. “Deployed” has a corresponding meaning.
Deployed Funds means, in any period, the aggregate funds that have been advanced by NYGB subject to the terms of fully negotiated client and partner financing agreements executed in that period, expressed in dollars. “Deployed” has a corresponding meaning.
Deployed Funds means an amount equal to (i) the Hausfeld Costs Sum; plus (ii) the Hausfeld Share of any and all sums paid or otherwise funded by the Funder pursuant to this Agreement and/or the HP LFA in respect of Common Disbursements (ii) the Hausfeld Share of the Legal Expenses Insurance Costs plus (iii) the Hausfeld Share of the sum set out in the Project Plan under the heading "Deal fee"; plus (iv) the Hausfeld Share of the Transaction Costs. For the avoidance of doubt, the HP Share of any sums paid or otherwise funded in respect of Common Disbursements pursuant to this Agreement or the HP LFA will be recovered pursuant to the HP LFA and neither the Claimants nor the Solicitors will have any liability to the Funder for this amount.
Examples of Deployed Funds in a sentence
Any sums paid by the Funder in respect of adverse costs and/or any Adverse Costs Order which are attributable to the Claimants, other than pursuant to Clause 9.1 shall be added to the Deployed Funds with a consequent adjustment to the Committed Funds.
