Borrower covenants and agrees to construct, erect, undertake and complete or cause to be constructed, erected, undertaken and completed each item of work set forth on Exhibit B hereto (the “Deferred Maintenance Work”) no later than the date for completion of such item of Deferred Maintenance Work set forth on Exhibit B or, if no such date is set forth for such item on Exhibit B, then within 120 days after the date hereof.
Borrower shall pay for and obtain or cause to be paid for and obtained all permits, licenses and approvals required by all applicable laws with regard to the Deferred Maintenance Work, whether necessary for commencement, completion, use or otherwise.
Borrower shall perform the Deferred Maintenance Work in a workmanlike manner and in accordance with all applicable laws, ordinances, rules and regulations.
Lender may require an inspection of the Property at Borrower’s expense prior to making a disbursement in excess of $50,000 in order to verify completion of the item(s) of Deferred Maintenance Work for which reimbursement is sought.
Borrower shall complete the lien-free performance of the Deferred Maintenance Work (as defined below) on or before December 31, 2000.
In addition to such balance, the Borrower will deposit in the Capital Expenditure and FF&E Reserve Account on the Closing Date (i) $1,992,000 for Deferred Maintenance Work, (ii) $117,000 for ADA Compliance Work and (iii) $206,000 for Environmental Remediation Work (collectively, the "Work").
Borrower shall complete the lien-free performance of the Deferred Maintenance Work (as defined below) on or before the date that is six (6) months after the Disbursement Date.
