  • During the past three years there has been no destruction, damage or casualty with respect to the DDS Transferred Real Property that has not been restored.

  • There are no matters that would be shown on an ALTA/NSPS survey of the DDS Transferred Real Property that individually or in the aggregate materially impair the current use and operation of the DDS Transferred Real Property.
