The maximum service credits issued in any one calendar month shall not exceed 100% of the MRC for the DDoS Mitigation Service.
In addition, the Customer acknow ledges and agrees that the DDoS Mitigation Service is not designed to address failures by upstream providers to transmit Internet Traffic.
During the term VM grants to Customer, and Customer accepts, a limited, non-exclusive, non-transferable, non- sublicensable licence to use and access the Customer Portal solely for purposes of using and accessing the DDoS Mitigation Service and view ing and managing Customer’s account and the data therein, solely in accordance w ith any applicable instructions or documentation provided by VM.
If VM determines that Customer has failed to comply w ith any provision of this section 45 or has undertaken or attempted to undertake any of the prohibited activities described herein, Customer agrees that VM may immediately take corrective action w hich includes, but is not limited to, suspension of the DDoS Mitigation Service and/or termination of the Agreement for Provision of Services w ith immediate effect upon notifying Customer (w hich may be via email).
Customer acknow ledges and agrees that it shall have no right to seek, and shall not seek, any indemnification from VM w ith respect to the DDoS Mitigation Service.
As a part of setting up the DDoS Mitigation Service for the Customer, VM w ill define a static traffic profile based on the information provided by the Customer in its onboarding form and using this w ill produce a static threshold list that defines the values beyond w hich Alarms and (depending on severity) mitigations w ill be triggered automatically.
Customer shall not combine any softw are provided by VM in connection w ith the DDoS Mitigation Service w ith any code or softw are licensed under the General Public Licence (“GPL”) or any other open source licence, in any manner that could cause, or could be interpreted to cause, such softw are (or any modifications thereto) to become subject to the terms of the GPL or such other open source licence.
The DDoS Mitigation Service and associated countermeasures are configured to reduce disruption of Customer’s legitimate traffic.
The following service level goals (“Goals”) apply to DDoS Mitigation Service, excluding DDoS Appliance Services which are provided on an as available basis with no applicable SLA.
If the Customer wants to add DDoS Mitigation Service to the Internet Access Services or Dedicated Internet Access Services, then the Customer must purchase DDoS Mitigation Service separately as part of the Order.
