DCP ICS definition

DCP ICS means Intentionally Created Surplus converted from Extraordinary Conservation ICS, System Efficiency ICS, or Binational ICS as set forth in these LBOps. Reductions in Colorado River water available to a state pursuant to Section XI.G.2.D. of the 2007 Interim Guidelines shall not constitute DCP ICS.

Examples of DCP ICS in a sentence

  • There shall be no system assessment on the creation of any ICS for conversion to DCP ICS as repayment pursuant to Sections III.F.3.b, III.F.4.b, and III.F.4.c above..

  • Top Heavy Group means an Aggregation Group in which, as of the Determination Date, the sum of:

  • USP-NF means the current edition of the United States Pharmacopeia-National Formulary.

  • Top Heavy Plan means a plan described in Section 9.2(a).

  • Super Top Heavy Plan means a plan described in Section 2.2(b).

  • Top Paid Group means the top 20 percent of Employees who performed services for the Employer during the applicable year, ranked according to the amount of "415 Compensation" (determined for this purpose in accordance with Section 1.26) received from the Employer during such year. All Affiliated Employers shall be taken into account as a single employer, and Leased Employees within the meaning of Code Sections 414(n)(2) and 414(o)(2) shall be considered Employees unless such Leased Employees are covered by a plan described in Code Section 414(n)(5) and are not covered in any qualified plan maintained by the Employer. Employees who are non-resident aliens and who received no earned income (within the meaning of Code Section 911(d)(2)) from the Employer constituting United States source income within the meaning of Code Section 861(a)(3) shall not be treated as Employees. Additionally, for the purpose of determining the number of active Employees in any year, the following additional Employees shall also be excluded; however, such Employees shall still be considered for the purpose of identifying the particular Employees in the Top Paid Group:

Notwithstanding the foregoing, an Employee who separated from service prior to 1987 will be treated as a Highly Compensated Former Employee only if during the separation year (or year preceding the separation year) or any year after the Employee attains age 55 (or the last year ending before the Employee's 55th birthday), the Employee either received "415 Compensation" in excess of $50,000 or was a "five percent owner." For purposes of this Section, "determination year," "415 Compensation" and "five percent owner" shall be determined in accordance with Section 1.26. Highly Compensated Former Employees shall be treated as Highly Compensated Employees. The method set forth in this Section for determining who is a "Highly Compensated Former Employee" shall be applied on a uniform and consistent basis for all purposes for which the Code Section 414(q) definition is applicable.

  • External beam radiation therapy means therapeutic irradiation in which the source of radiation is at a distance from the body.

  • Groceries means food as defined in 7 U.S.C. 2012(k), but does not include cannabinoid

  • Pay Channel means a channel which is declared as such by ZEEL and for which a share of maximum retail price is to be paid to ZEEL by the IPTV Operator and for which due authorization needs to be obtained from ZEEL for distribution of such channel to subscribers.
