If Developer commences or continues any D&C Work affected by such a change after the need for the change was discovered or suspected, or should have been discovered or suspected through the exercise of reasonable care, Developer shall bear any additional costs associated with redoing the D&C Work already performed.
Any such Betterment shall be deemed added to the scope of the D&C Work only upon execution by the Utility Owner and Developer and approval by TxDOT of a Utility Agreement identifying and providing for performance of such Betterment.
The Project Schedule shall be used by the Parties for planning and monitoring the progress of the D&C Work and as the basis for determining the amount of monthly progress payments to be made to Developer.
Developer may modify the Construction Documents without prior approval of TxDOT, but must deliver the modifications to TxDOT in advance of performance of the applicable D&C Work.
Commencing upon issuance of NTP2, Developer shall provide appropriate security for the Site, excluding the Existing Harbor Bridge, and shall take all reasonable precautions and provide protection to prevent damage, injury, or loss to the D&C Work and materials and equipment to be incorporated therein, as well as all other property at or on the Site, whether owned by Developer, TxDOT, or any other Person.
